earthquake kills hundreds. tonight, the race to save the students. and first from fox tonight, dramatic and new warnings about the iranian's nuclear ambitions and the steps the u.s. government could take to stop them. a top pentagon official today told the senate armed services committee that a military attack against iran is still an option to slow down that nation's efforts to build a nuclear weapon. now, nothing has ever been taken off the table. the undersecretary of defense the military option is not the preferred option but its did exist because president obama hasn't taken it off the table. john mccain the republican, looking to hammer home the idea that america has to do something. >> make no mistake, if iran achieves a nuclear weapons capability, it will not be because we couldn't stop it but because we chose not to stop it. >> shepard: that's up for debate. the problem is that administration officials generally say a military strike

against iran would only set the nuclear program back. it would not stop it. this debate all the more urgent in light of the warnings we heard repeated today that iranians could have a nuclear bomb within a year. but couldn't use it until much later, even if that does happen. our chief correspondent for "the fox report" from new york. if they did get it within a year they couldn't use it right away. >> no, they couldn't. most experts agree it would take them another three years to get it to a form in which they could deliver it as a weapon. in other words, miniature rise it enough to put it on the head of a missile that news comes as we also learn today slightly worrying development that iran's nuclear reactor at the power plant will be ready to open in august. that word coming from the russians who are helping to build that reactor. they say that it is not a threat in any way at all others, obviously, would beg to differ.

>> shepard: iran's president was, again, defiant today with all kinds of lashing out. and he said he would talk to the united states but only what he called the right circumstances. >> yeah. and the right circumstances as always with president ahmadinejad means what he calls the u.s. respecting iran's rights. in other words, the u.s. backing off about iran's nuclear program. so, in essence, this was the same defiance we have always heard. he said that the u.s. is trying to dominate the world and iran is the only country that is capable and willing to stand up to the united states, shep. >> shepard: you know, jonathan, we really are seeing new signs that the international community, as it were, might turn up the pressure on iran again. >> yeah. the united nations calls this the sixth major powers. they include russia, the u.s., and china. they met today to start discussing a draft resolution for new penalties or sanctions against iran if it proceeds with its nuclear ambitions. but we're hearing from the united nations tonight, shep, that china and the u.s. remain far apart.

the u.s. wants biting sanctions, china wants them to be much, much weaker. it will take weeks, it not months to get to a vote at the united nations on these new sanctions, shep. >> shepard: jonathan hunt on the new sanctions, thanks. the road to recovery and there are brand new signs as fox reports tonight that america could be on that road now with folks spending more money on everything from clothes to curtains to cars. the commerce department reports today retail sales were up last month 1.6%. a bigger increase than any of the analysts had been expecting. this is a big deal since consumer spending as we reported repeatedly here accounts for almost three quarters of the economic activity. it's making a difference. feds report businesses have increased inventories as half a percent as they anticipate shopper also spend more money. inflation is holding steady at least for now. consumer prices were up only a

tenth of a percent last month. today the chairman of the fed ben bernanke spoke about how your shopping habits are helping the country get out of the recession. >> suggest that growth and private demand will be sufficient to promote a moderate economic recovery in coming quarters. >> he reports the moderate recovery he mentioned will not be strong enough to bring quick relief to high unemployment. adam shapiro from fox business joins us now. the fed chair says he was concerned about this latest jobs report. >> he is concerned about it because it is taking so long for people to find jobs. what he is worried about in particular is the longer you are unemployed, the longer it takes to find a job. here is how he told congress about it. >> if the pace of recovery is moderate as i expect, significant amount of time will be required to restore 8.5 million jobs that were lost during the past two years. i'm particularly concerned about the fact that in march 44% of the unemployed had been without a job for six months or more. long periods without work erode

individual skills and hurt future employment prospects. >> now, there is one thing that the fed is watching. shep, it's something we should all watch. the baby boomers, they have been delaying their retirement because the stock market has fallen. it's coming back. they may start retiring. it could be a positive thing for employment. >> shepard: then again for the retiree benefits. bernanke is worried about one thing and that's the growing debt. >> he has been doing this for years. in particular he laid it out in numbers we can understand. 2020 at the way we are spending at the government level 100% the debt would be equivalent to 100% of g.d.p. in real terms spending between 900 billion to a trillion dollars just on interest on the national debt. that's a huge amount of money we can't afford. >> shepard: quite a predicament. even as adam talked to moderate recovery a big name investor, a conservative warned the obama administration has made investing in the united states a political risk as he put it. the billionaire sam zel calls

the current political environment frightening and says and i quote: of course, a lot of this is politics, but this is an important investor with a lot of cash. >> he is echoing the same thing that ben bernanke is saying about government spending. you have to ask why mr. zell would say this when he is saying it is difficult to invest in the united states, he is investing in the united states buying up distressed properties like george soros who has a concern about government debt worldwide. he called gold asset bubble and bought million dollars worth of gold sometimes you have to question the motives. >> shepard: indeed. adam shapiro. great to see you. higher taxes on the rich, and they are coming, help reduce the deficit? of course this is an economic sort of philosophy question. and it goes to all of our problems. and we would like to know what you think.

foxnews.com/shep. we have an online poll right now. we will reveal the results a little later. does taxing the rich help reduce the deficit? there is a place for you to comment there, too. foxnews.com slash shep. more fallout after a tennessee mother returned her adoptive child to russia like some sort of return at the department store. minutes ago the democratic senator mary landrieu of louisiana released a statement. in it she called for a full investigation by the department of state and asked officials in the state of tennessee to file the strongest possible charges against the adoptive mother. that mother is a woman named torry hansen. she says the 7-year-old whom she adopted has severe psychological problems she accuses the russian orphanage of hiding those from her. she flew the boy to washington with his adoptive grandmother. she took off. putting the child on a plane all by himself to moscow. the mother reportedly paid somebody to pick up the kid at the airport. before doing so, she pinned a note to the boy's jacket. there he is. a note saying is he mentally

unstable and that after giving it her best shot, for her safety, for herself, and her family, she no longer wished to parent this child. officials in russia call what she did a monstrous deed and threatened to suspend pending adoptions in the united states. so during "studio b" this afternoon i spoke to the u.s. embassy official in moscow who handles adoptions. >> none of us want to see anything like this happen again. we will sit down with the russians next week and do everything we can to make sure this doesn't happen again. in the past year, about 1500 russian orphans were brought to new homes in the united states. and they were loving, caring homes. it's terrible that we have this one awful situation but it can't take away from the fact that this is a good thing. >> shepard: we're told about 3,000 pending adoptions from russia to the united states. well, the attorney general is giving us a new clue tonight about where the confessed 9/11 mastermind might face justice.

officials now estimate more than 10,000 others are injured. and it's really impossible to say how many might be stuck in the rubble, desperate for help. >> all across the region, the same heart wrenching scene, rescue crews frantically digging through collapsed buildings looking for any signs of life. here teens pulled a boy from the remains of his school. fortunately the quake hit early in the morning and a lot of students apparently hadn't arrived. at this site a buddhist monk joined rescuers. the quake hit hard here. houses are made of nothing but wood and mud. the government is rushing in supplies but relief missions are a real challenge because the area sits in an al tuesday of 13,000 feet. and the airport isn't equipped for heavy traffic. with temperatures plunging below freezing at night, the race is on to get supplies to the survivors, before its too late. >> shepard: the experts say

china has relatively solid earthquake building codes but they are perhaps not as enforced as well as they should be and that causes problems when any major quake hits. the u.s. attorney general defending the obama administration's policies in the fight against terror. eric holder did not back down from the critics on the senate judiciary committee today. and some of what he said is getting plenty of attention. for instance, eric holder says the administration is trying to capture osama bin laden alive and would not read to read miranda rights to the terrorist. the fbi got valuable intelligence from the so-called underwear bomber seen here the guy who tried to blow up a flight over detroit on christmas day. maybe holder's most controversial statement was about a decision on where to handled 9/11 terrorist suspects' trial. listen here. >> new york is not off the table as a place where they might be tried but we have to take into consideration the concerns that have been raised by local officials and by the community

in new york city. >> shepard: those officials and the community heard the attorney mentioned have said a lot about trying terrorist suspects here. the democratic new york senator chuck schumer responded with this statement: that was one of the more mild responses. catherine herridge works security for us. she is live in d.c. a new york republican weighed in for potential sites for the trial too auto. what did he say. >> senior democrat king did not hold back. >> i'm absolutely appalled by attorney general holder. when i heard his testimony this morning, it's an absolute disgrace. the fact is that this was the most irresponsible decision any administration ever made. >> today on the hill, the attorney general was urged by republicans to take a position on the trial and not let the white house call the shots, in their opinion, shep. >> shepard: what else did the attorney general have to say about osama bin laden? he has been all over the place on this one. >> well, earlier this year the attorney general said it was unlikely osama bin laden would

be captured alive. but today he said they would really like to get him. >> with regard to osama bin laden, who is our target one for the united states, our plan is to capture him or to kill him. our hope would be to capture him and to interrogate him, to get useful intelligence from him. >> and the attorney general went on to say specifically they want intelligence on the al qaeda leadership and its structure of al qaeda itself, shep. >> shepard: attorney general holder says there are two parallel tracks in this system to put suspected terrorists on trial. >> well, that's right. holder says that there is the military track and the civilian track. but critics point to the fact that really for the justice department, the starting point are federal civilian trials. and then when they look at the evidence and other factors, it's only then they make a decision to move suspected terrorists into a military system. critics say it ought to be the other way around because in almost every case these people

>> shepard: today, united states officials confirm to fox news it seems terrorists were plotting a new 9/11-style attack using hijacked planes to crash into buildings, or that was the plan.

security forces report terrorist working with al qaeda in iraq were planning to fly planes into shiite religious shrines. they were planning after they left iraq airports. last week the iraqis closed down the airports in this shrine near najaf as a security precaution. it is not clear to us how far the terrorists had gotten with this plan. but the officials tell us that they have arrested two men so far and the prime minister, nouri al maliki has reportedly ordered increased security screening at all airports in the country along with background checks for all pilots and flight crews. the middle east has been getting more tense reports that syria sent long range scud missiles to the military group hezbollah in lebanon. take a minute to think

reach just about any spot inside israel. this is happening just as we are seeing signs of, well, tensions at least between the president obama and the israeli prime minister benjamin netanyahu. our mike emanuel has been following all of this with great interest in the pentagon. >> one who has been negotiating middle east peace deals in the past call these particularly tense times between the u.s. and israel and says this is more than just a bump in the road. president obama hosted his nuclear summit this week with more than 40 world leaders in town but israeli prime minister benjamin netanyahu was not here. some experts say part of the reason is he was not sure the kind of reception he would get in washington. the israeli prime minister was at the white house three weeks ago for private meetings with

the president, which were reportedly quiet tense. one area where they disagree, jewish settlements in a disputed part of jerusalem. now word syria is in the process of sending long range scud missiles to hezbollah and lebanon capable of hitting jerusalem and tel aviv. the white house says it is increasingly concerned about the sophisticated weapons apparently being transferred. robert gibbs was pressed on that by my colleague major garrett earlier today. >> we have relayed our concerns. >> [inaudible] >> we have. and. >> at the highest level? >> yes. >> gibbs was asked later in the briefing about the relationship between the u.s. and israel. he says the u.s. and israeli people have an unbreakable bond but he did not mention the netanyahu government. shep? >> shepard: mike emanuel at the pentagon tonight. mike, thank you. if you had the choice, would you want your taxes raised? some rich folks are now saying yes. raise our taxes.

monitor their favorite players, batting averages and pitch speeds the high tech cameras are watching too. they are giving scouts and coaches stats that could change the box scores forever. adam housley with the plumb assignment at the ballpark in san francisco tonight. hey, adam. >> hey, shep. from the crack of the bat to the snap of the glove, you mentioned it baseball players have been followed closely and their stats by scouts, their coaches, fans and front office personnel for generations. >> in the modern era, statistics have turned performance into a science. adding more objective elements into team calculations about who to put on the field. today, technology is adding another layer thanks to cameras that can track the position of the ball and every player on the field 15 times a second. >> when a new technology emerges, and does have an impact on the team, you know, we want to be among the first so we can have competitive advantage. they don't last for long though.

regulate wall street after the 2008 national meltdown that resulted in so many americans losing their jobs, homes beings and retirement savings. >> if there is one lesson that we have learned, it's that a unfettered market, where people are taking huge risks and expecting taxpayers to bail them out when things go sour, is simply not acceptable. >> shepard: president meeting with top lawmakers from both parties talking about ways for the government to oversee the types of risky investments that cause some problems. they still haven't done that senior white house correspondent major garrett live on the north lawn. what's the plan now. >> shepard, through the minor miracle of videotape we will sound of the president's outline -- the biggest issue in washington is will there be a fund established to protect taxpayers from future needs for bailouts? that is to say if a big financial institution is about to collapse, who intervenes? how does the federal government intervene? and who finances that intervention to slowly wind that

big bank or big financial institution down? that's what congress is working on. that's what the administration is working on. here are other parts of the president's financial regulatory reform agenda. >> we never have too big to fail again that consumers are adequately protected when it comes to financial instruments, whether it's mortgages or credit cards or debit cards. that we have a strong mechanism to regulate derivatives. something that we have not had. >> the president's press secretary robert gibbs told us today in the briefing, shepard, that bipartisanship is good but the president will not sacrifice bipartisanship for bad policy, meaning republicans need to get on board. >> shepard: at the risk of this being news to no one, it's politically divisive as always. >> indeed, shepard. republicans' first complaint is that they are locked out of negotiations or they have been mostly locked out of negotiations. back to this issue of how do you wind down firms in the future that may fail and protect

taxpayers. the senate republican leader mitch mcconnell after meeting with the president just this morning came out and told reporters the current legislation simply does not do that and doesn't sufficiently protect taxpayers. let's listen. >> it's a bill that actually guarantees future bailouts of wall street banks. in fact, if you look at it carefully, it will lead to endless taxpayer bailouts of wall street banks. that is clearly not the direction the american people would like for us to go. >> treasury secretary tim geithner in the briefing room shepard absolutely denied that he said what will be financed is something paid for by big financial institutions through some kind of fee that is yet to be determined. back to you in new york. >> shepard: thank you, major. major garrett in the yard at the white house. it is all your money. hope you like potatoes. according to the group citizens against government waste, the feds spent more than 2.5 million of your dollars on potato

research this fiscal year. one of many projects known as earmarks. you may have heard of them. lawmakers tack them on to spending bills. it's routine. other examples of what critics call pork barrel spending including 4. million dollars for wood utilization research. a quarter of a million dollars for a farmers market in monroe county, kentucky. i'm sure it's nice. $300,000 for music education programs at carnegie hall. william la jeunesse has been looking into how much of all of this is costing you, specifically you. william? >> well, shepard, you know the first step to recovery is admitting you have a problem. but will congress concede an addiction to earmarks? those pet projects dolled out by lawmakers for the sole benefit typically of a local employer or town like millions for textile research in north carolina. thousands for tattoo removal in california. and almost a million for fish management in alabama. >> earmarks are not historically necessary. we don't need to have them. and they have gotten completely

out of control. if you want to see a river of wasteful spending going alongside the federal budget, all you need to do is look at the amount of earmarks that we are spending money on every year. >> including almost 500 million for a jet engine the pentagon independent panels say are quote, not necessary and not affordable. and 200 million for a second avenue subway in new york city. now, how much is that subway costing you? you can now figure it out with the fox news taxpayer calculator. first, you enter your income. in this case we are using $50,000. now, at the top of the pie chart we will show what portion of the earmarks are paid for by your tax bracket. in this case about 18%. then it will show your share of the cost with an income of 50 grand, it's about $1. the top wage earners about 24 bucks. now, that may not sound like a whole lot. but, remember there are 535 members of congress who have been doing this for years. and there were about 9,000 earmarks this fiscal year, shepard, totaling about
